This Privacy Notice explains how Wellier Ltd ('Wellier', 'we', 'us' or 'our') collects, uses, stores, shares and otherwise processes personal information when you visit our website, contact us or use our private healthcare coordination services.

Wellier is a UK-based private healthcare coordination service. We help clients access and arrange services with independent healthcare professionals and providers, which may include doctors, pharmacists, pharmacies, nurses, nursing agencies, physiotherapists and other appropriate healthcare providers.

Wellier does not itself provide clinical assessment, diagnosis, medical advice, prescribing or treatment. Clinical services are provided by the relevant independent healthcare professional or healthcare organisation.

This Privacy Notice applies when you:

  • contact us by telephone, email, WhatsApp or online form;
  • ask Wellier to arrange or coordinate a healthcare-related service;
  • communicate with us in relation to an existing request; or

1. Who Is the Data Controller?

Wellier Ltd is the controller of the personal information described in this Privacy Notice where Wellier determines the purposes and means for which that information is processed.

Independent healthcare professionals and healthcare organisations may act as separate data controllers in relation to clinical information that they receive, create or otherwise process in connection with the healthcare services they provide.

Further information about this distinction is provided in Section 8.

2. What Information Do We Collect?

We collect personal information that is reasonably necessary to respond to your enquiry, understand your request and coordinate the service you have asked us to arrange.

Depending on the circumstances, this may include:

  • your name;
  • telephone number;
  • email address;
  • date of birth;
  • hotel, home, office or other service location;
  • the type of healthcare service requested;
  • the urgency or preferred timing of your request;
  • communications between you and Wellier;
  • administrative or transaction information relating to a service;
  • information necessary to arrange a delivery or appointment where applicable; and
  • health information that you provide where it is relevant and necessary to understand or coordinate your healthcare request.

Health information

Information concerning your health is classed as special-category personal data under UK data protection law and is subject to additional protection.

Depending on your request, this may include limited information about symptoms, medication needs, existing health circumstances or other health-related information that you voluntarily provide and that is relevant to arranging the requested service.

We aim to collect only the health information reasonably necessary for Wellier's coordination role. Wellier does not seek to create a substitute clinical record for the independent healthcare professional or provider responsible for your care.

Information automatically collected

When you visit our website, certain technical information may be collected automatically. This may include your Internet Protocol (IP) address, browser and device characteristics, operating system, referring URL, timestamps and information relating to the operation and security of the website.

This information is primarily used to maintain the security, functionality and operation of our website and systems.

3. Do We Receive Information From Third Parties?

We generally collect personal information directly from you.

In some circumstances, a hotel concierge, personal assistant, family member or other intermediary may introduce you to Wellier, connect you with us or provide limited information necessary to facilitate an introduction where they are acting on your behalf.

We do not ordinarily rely on such intermediaries to provide detailed personal or health information about you. Once an introduction has been made, we will normally communicate directly with you in relation to your healthcare request.

Where a healthcare service has been coordinated, we may also receive limited information from an independent healthcare professional or provider in connection with the administration, status or outcome of your service request where this is relevant to Wellier's coordination role.

4. How and Why Do We Use Your Information?

We may process personal information for the following purposes:

  • To respond to enquiries and communicate with you about Wellier and our Services.
  • To understand your request and determine the type of service you are asking Wellier to coordinate.
  • To provide and administer our coordination Services, including taking steps at your request before a service is arranged.
  • To coordinate healthcare services, including identifying and contacting an appropriate independent healthcare professional or provider.
  • To communicate information reasonably necessary to an independent healthcare professional or provider in order to facilitate your request.
  • To communicate with you about appointments, services, deliveries, updates or other administrative matters relating to your request.
  • To administer payments, invoices and business records where applicable.
  • To manage complaints, incidents and service quality.
  • To protect our website, systems and business, including preventing, identifying or investigating misuse, security incidents or fraud.
  • To comply with legal and regulatory obligations.
  • To establish, exercise or defend legal claims, including where relevant to insurance, complaints or disputes.
  • To protect vital interests in exceptional circumstances where processing is necessary to protect the life of an individual.

6. How Do We Process Health Information?

Health information is special-category personal data under the UK GDPR. Processing special-category personal data requires both an Article 6 lawful basis and a separate condition under Article 9 of the UK GDPR.

Where Wellier processes health information for the purpose of understanding and coordinating your healthcare request, Wellier currently relies on Article 9(2)(a) of the UK GDPR — your explicit consent.

Where health information is required, we will ask you to expressly consent to Wellier processing the health information you provide for the specified purpose of understanding and coordinating your healthcare request.

This may include sharing information reasonably necessary for the request with the independent healthcare professional or provider identified or arranged to fulfil it.

Your explicit consent will be requested separately and recorded. You may withdraw your consent at any time by contacting us.

Withdrawal of consent will not affect the lawfulness of processing carried out before consent was withdrawn. However, where the relevant health information is necessary for us to understand or coordinate your request, withdrawing consent may mean that Wellier is unable to continue coordinating that Service.

In exceptional circumstances involving a genuine threat to life where you are physically or legally incapable of providing consent, another condition permitted by applicable data protection law may apply where strictly necessary.

Wellier is not an emergency service. If you require emergency medical assistance, please call 999.

7. Who Do We Share Information With?

We share personal information only where reasonably necessary and where there is an appropriate legal basis for doing so.

Depending on your request and the circumstances, recipients may include:

  • independent doctors and other medical professionals;
  • pharmacists and pharmacy organisations;
  • nurses and nursing agencies;
  • physiotherapists and other allied healthcare professionals;
  • other appropriate healthcare providers relevant to your request;
  • delivery and logistics providers where necessary for a requested delivery;
  • website hosting and technology providers;
  • cloud storage and data-hosting providers;
  • communication and collaboration service providers;
  • payment and accounting service providers where applicable;
  • professional advisers, including legal, accounting and insurance advisers;
  • regulators, law-enforcement authorities, courts or public authorities where disclosure is required or permitted by law; and
  • another person or organisation where you have specifically asked or authorised us to disclose information.

Service providers acting on Wellier's behalf

We may use technology and other service providers that process personal information on Wellier's behalf.

Where an organisation acts as a processor for Wellier, we require appropriate contractual and data-protection arrangements in accordance with applicable law.

Business transfers

We may disclose or transfer personal information in connection with a proposed or completed merger, restructuring, financing, acquisition, sale of assets or other transaction involving all or part of our business, subject to appropriate confidentiality and data-protection safeguards.

We do not sell your personal information.

8. Our Role as a Healthcare Coordinator

Wellier provides healthcare coordination services. Wellier is not itself the healthcare professional responsible for your clinical care and does not itself provide clinical assessment, diagnosis, medical advice, prescribing or treatment.

When you make a healthcare request, Wellier may collect information reasonably necessary to understand and coordinate that request.

We may then identify and contact an appropriate independent healthcare professional or provider and share information reasonably necessary for that professional or provider to respond to or fulfil your request.

Depending on the request, this may include a doctor, pharmacist, pharmacy, nurse, nursing agency, physiotherapist or another appropriate healthcare professional or organisation.

Independent healthcare professionals and healthcare organisations are responsible for their own clinical decisions and for the clinical records that they are required to create and retain.

Where they independently determine the purposes and means for which clinical information is processed, they will generally act as separate data controllers for that processing.

Wellier may receive limited information from a provider concerning the administration, status or outcome of your request where this is relevant to our coordination role.

Requests for deletion where a healthcare provider holds records

Where personal information has been shared with an independent healthcare professional or provider, that provider may retain its own clinical and other records independently of Wellier.

A request for erasure made to Wellier does not automatically require an independent healthcare provider to erase records that it is entitled or required to retain under its own legal, clinical, professional or regulatory obligations.

Where appropriate, you may need to exercise your rights separately with the relevant healthcare provider in relation to information for which that provider is the controller.

9. International Transfers

Some of the technology and service providers used by Wellier may store, access or process personal information outside the United Kingdom.

Where personal information is transferred outside the United Kingdom, we take steps to ensure that the transfer complies with applicable UK data protection law.

Where the destination has not been recognised as providing an adequate level of data protection, we will use an appropriate lawful transfer mechanism where required.

Such safeguards may include the UK International Data Transfer Agreement, the UK Addendum to approved Standard Contractual Clauses or another transfer mechanism recognised under UK data protection law.

10. How Long Do We Keep Your Information?

We keep personal information only for as long as reasonably necessary for the purposes for which it was collected, unless a longer period is required or permitted by law.

Different categories of information may be subject to different retention periods, taking into account the nature of the information, the purposes for which it is processed and applicable contractual, legal, regulatory, accounting, tax, insurance and dispute-resolution requirements.

Enquiries that do not result in a Service will generally be retained for up to 12 months after the enquiry has been resolved, unless there is a legitimate reason or legal requirement for us to retain the information for longer.

Information relating to a Service coordinated by Wellier may be retained for a longer period where reasonably necessary for contractual, administrative, accounting, tax, legal, regulatory, insurance, complaints-handling or claims-management purposes.

Evidence of consent may be retained for as long as reasonably necessary to demonstrate the basis on which the relevant processing occurred.

When information is no longer required, we will take reasonable steps to delete, anonymise or securely dispose of it, subject to information that must be retained by law or that remains temporarily within secure backup systems.

Independent healthcare professionals and providers maintain their own clinical records separately from Wellier and apply their own legal, professional and regulatory retention requirements.

11. How Do We Protect Your Information?

We use appropriate technical and organisational measures designed to protect personal information against unauthorised or unlawful processing and against accidental loss, destruction, alteration, disclosure or access.

These measures may include access controls, account security, restricted access to personal information, secure technology systems, confidentiality requirements and appropriate arrangements with organisations processing information on our behalf.

Access to personal information is limited to individuals and organisations that require it for legitimate purposes and who are subject to appropriate confidentiality or data-protection obligations.

No method of electronic transmission or storage can be guaranteed to be completely secure. We therefore continually review our safeguards having regard to the nature and sensitivity of the information we process.

12. Cookies and Similar Technologies

We currently use only cookies and similar technologies that are strictly necessary for the security, functionality and basic operation of our website.

We do not currently use cookies or similar technologies for advertising, behavioural tracking or analytics purposes.

If our use of cookies or similar technologies changes in the future, we will update the information we provide to users and, where required by applicable law, obtain appropriate consent before using non-essential technologies.

13. Marketing

We will only send electronic direct marketing communications where we are permitted to do so under applicable law.

Where consent is required, we will obtain that consent before sending marketing communications.

You may opt out of marketing communications at any time by using the unsubscribe method provided in the communication or by contacting us.

Opting out of marketing will not prevent us from contacting you about a Service you have requested or sending other necessary administrative communications.

14. Information Relating to Minors

Our Services are intended for use by adults.

We do not knowingly invite children to submit personal information directly through our website or service request process.

If a healthcare request relating to a minor is made, we may require the request to be handled directly with a parent, legal guardian or another person who has appropriate authority to act on the minor's behalf before we proceed.

15. Your Data Protection Rights

Under UK data protection law, you may have certain rights in relation to your personal information, subject to applicable conditions and exemptions.

These may include the right to:
